{"id":6863,"date":"2024-01-09T11:34:49","date_gmt":"2024-01-09T19:34:49","guid":{"rendered":"https:\/\/www.thor.ca\/?post_type=tax_alert&#038;p=6863"},"modified":"2025-02-14T13:07:58","modified_gmt":"2025-02-14T21:07:58","slug":"artificial-intelligence-ai-in-federal-court","status":"publish","type":"post","link":"https:\/\/www.thor.ca\/blog\/2024\/01\/artificial-intelligence-ai-in-federal-court\/","title":{"rendered":"Artificial Intelligence (AI) in Federal Court"},"content":{"rendered":"<p>On December 20, 2023, the Federal Court released a <a href=\"https:\/\/www.fct-cf.gc.ca\/Content\/assets\/pdf\/base\/2023-12-20-notice-use-of-ai-in-court-proceedings.pdf\">Notice to the Parties and the Profession on the use of Artificial Intelligence (AI)<\/a>. The Notice applies to all documents that are either submitted to the Court or prepared for the purpose of litigation.<\/p>\n<p>Per the Notice, the Court recognizes the value of AI and does not prohibit its use. To increase transparency, however, the Court requires a declaration in any document that contains AI-generated content which is prepared for the purpose of litigation and submitted to the Court. This declaration must be in the first paragraph of the document and should read: \u201cArtificial intelligence (AI) was used to generate content in this document.\u201d<\/p>\n<p>Concurrent with the release of the Notice, the Federal Court released a separate webpage titled <a href=\"https:\/\/www.fct-cf.gc.ca\/en\/pages\/law-and-practice\/artificial-intelligence\">\u201cInterim Principles and Guidelines on the Court\u2019s Use of Artificial Intelligence.\u201d<\/a> As noted therein (among other things), the Court will not use AI to make its decisions or render its judgments without first engaging in public consultation.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On December 20, 2023, the Federal Court released a <a href=\"https:\/\/www.fct-cf.gc.ca\/Content\/assets\/pdf\/base\/2023-12-20-notice-use-of-ai-in-court-proceedings.pdf\">Notice to the Parties and the Profession on the use of Artificial Intelligence (AI)<\/a>.
